What is involved in a personal injury case?

A person who is injured, through no fault of their own, can recover damages against the person who is at fault and responsible for the damage. Typically this involves a lawsuit for negligence, but can involve other claims as well for what are known as intentional torts. We only take a fee if you recover, and the standard fee is one-third of your recovery. The process typically involves contacting your health care providers to obtain your health care bills and reports, and thereafter monitor your progress until you reach maximum medical improvement (which is when the doctors believe with a reasonable degree of medical certainty that your condition will not improve). Once you have reached maximum medical improvement we would normally contact the insurance company and make a demand for settlement of your claim. Only if this process of negotiation with the insurance company is unsuccessful would a lawsuit be brought to recover in Court. We will not wait for maximum medical improvement if the statute of limitations is about to expire, and for Maine you have six years from the date your cause of action accrues to file a lawsuit, and in New Hampshire you have three years from the date your cause of action accrues to file a lawsuit.
